Club Cosmo’s reserves the right to refuse service, terminate accounts, or cancel orders at our discretion if misuse, fraud, or abuse is suspected.

 

2. Product Information & Availability

We strive to display accurate product descriptions, pricing, and imagery. However, minor variations in color, sizing, or appearance may occur due to screen settings, manufacturing processes, or material differences.

All products are subject to availability. We reserve the right to limit quantities, discontinue items, or cancel orders if inventory becomes unavailable. In such cases, customers will be notified and refunded accordingly.

 

3. Order Processing & Shipping

Shipping timelines and processing times are estimates only and not guaranteed delivery dates.

• In-stock orders placed by 12:00 PM PST, Monday–Thursday, typically ship within 5–8 business days (please allow for 1–5 day processing).
• Orders placed after 12:00 PM PST on Thursday generally ship the following Monday, excluding holidays.
• Pre-order items will display an estimated ship date on the product page.

In compliance with the Federal Trade Commission (FTC) Mail, Internet, or Telephone Order Merchandise Rule, Club Cosmo’s provides shipment estimates based on reasonable expectations and communicates delays when applicable.

 

4. Risk of Loss & Delivery Confirmation

Once an order has been shipped and marked “Delivered” by the carrier, the order is considered fulfilled.

In accordance with the Uniform Commercial Code (UCC §2-509) and standard e-commerce practices, risk of loss transfers to the customer upon carrier confirmation of delivery.

Club Cosmo’s is not responsible for:

• Lost or stolen packages after delivery confirmation
• Carrier delays
• Incorrect delivery details provided by the customer

5. Returns, Refunds & Exchanges

All returns, refunds, and exchanges are governed by our FULL IN-DEPTH RETURN POLICY, which is incorporated into these Terms by reference.

• Returned items must meet eligibility requirements outlined in the Return Policy.
• Refunds are issued only after returned items are successfully received and inspected.
• Refund processing times may vary depending on the customer’s bank or payment provider.

Club Cosmo’s reserves the right to deny returns that do not comply with policy requirements.

 

6. Chargebacks & Payment Disputes

By completing a purchase, you agree to contact Club Cosmo’s directly before initiating a chargeback or payment dispute.

We maintain documentation including order confirmations, tracking numbers, delivery confirmation, and policy acknowledgments to respond to disputes through Shopify, Stripe, and associated payment processors.

Fraudulent chargebacks may result in account restrictions or permanent bans.

7. Intellectual Property

All content on this website including logos, designs, artwork, text, graphics, product names, and branding is the exclusive property of Club Cosmo’s and protected under U.S. Copyright Law, Trademark Law, and applicable intellectual property statutes.

To the fullest extent permitted by law, Club Cosmo’s shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our products or website.

Our total liability shall not exceed the purchase price of the product giving rise to the claim.

Any disputes shall be resolved exclusively in the state or federal courts located in California.
